I2014 KYFCE FILM FESTIVAL

 

 

Video Submission:

 

  • Video to be 3 -5 min. in length.

  • Spoken Language – Spanish

  • Original creative piece or literary adaptation in Spanish (ONLY if in public domain).

 

Festival Calendar:

 

  • Video Submission-April 10

        All films must be submitted to the Festival Organizing Committee Members 

 

  • Film Festival-April 20 in CB103 at 3:30pm 

 

Key Information:

 

  • Music must be properly purchased or obtained. Music bought on iTunes, Amazon, etc. is not allowed as purchases there do not give you proper licensing for production use.

  • Adaptations must be in the Public Domain.

  • Give credit where it’s DUE (i.e. music, original author, etc.).

  • Please review all Entry Terms to ensure that your project is following approved guidelines.

  • Submissions remain private until after the Film Festival, when all submissions will be made available for public viewing and enjoyment on the KYFCE YouTube channel.

  • Keep projects with your target audience in mind (i.e. an audience potentially including a public of all ages).  The project may be a drama, comedy, music video, animated video, etc... You decide your story.

KYFCE FILM FESTIVAL

 

1. Eligibility:

 

Eligibility for participation and awards in this Film Festival is limited currently to Projects/Entries with students enrolled at the University of Kentucky. Projects can include the involvement of students from outside of the Department of Hispanic Studies, and beyond the University of Kentucky, but all communication and registration information has to be coordinated by a University of Kentucky student.

 

2. Entry and Submission Requirements:

 

A. Contest Entry

To enter the Film Festival, Entrants should create and submit one (1) video submission. Video submissions should reflect the language learning or cultural competency skills of the Spanish students in a creative manner. For the purpose of this Film Festival, a Video Submission is any completed file format of the Entrants choosing that is supported by YouTube (YouTube Supported File Formats). HD movies are optional but their use will not grant an advantage on the scoring process for the Film Festival. 

 

B. Video Submission:

1. Running Time: 3 - 5 minutes including titles and credits. Video Submissions with original content longer than 10 minutes are subject to disqualification.

2. Language: The Entry must be in Spanish. the Entry will not be eligible for any prize consideration and may be withdrawn from this competition at any time at the sole discretion of the Festival Organizers.

3. Creative Requirements: All Entries must be an original work and/or based on Latin- American, Latino or Spanish Peninsular cultural forms available in the Public Domain.Entries can be any genre of the Entrants’ choosing including, but not limited to comedy, tragedy, music video, documentary, etc. If the Entry is a literary adaptation, all accreditation to author(s) and work(s) must be observed in the opening titles and/or credits. 

 

3. Judging to Determine Finalists:

 

A Judging Committee comprised of preselected individuals by the Department of Hispanic Studies will initially screen all Eligible Entries.  The Judging Committee in general will be composed of two (2) Grad. Students, one (2) Faculty members, and/or one (1) Undergraduate/Non Department Entity. The Department of Hispanic Studies retains the right to change the type and amount of members in the Judging Committee at any time as it sees fit for the purposes of the Film Festival. 3 KYFCE FILM FESTIVAL Each member will score each Entry based on the following judging criteria (“Judging Criteria”) and associated point score (0 = worst; 5 = best):1. Is the story topic interesting and compelling?2. Was the story portrayed from an original and unique perspective in an engaging storytelling style?3. How well was the command of the Spanish/Portuguese language used?4. How well did the Entrant technically execute the video? (i.e. the use of camera, sound, lighting, and editing)5. What was the overall impression? The Judging Committee will convene and, based on the Judging Criteria, the Judging Committee will determine the top scoring six (6) Eligible Entries, of which the top three (3) will be known as the “Finalists” and the remaining three (3) Eligible Entries will be known as the “Runner- ups.” In the event of a tie, all tied Finalists will be independently re-evaluated using the Judging Criteria above to break the tie. The Judging Committee’s decisions are final and binding in all matters relating to the Film Festival. In the event of fewer than six (6) Entries that comply with these Regulations, the Department reserves the right to advance only Entries who are in compliance with the Regulations and meet all other eligibility requirements of the Film Festival. At the close of the Film Festival, all entries will be available for public viewing on the KYFCE Film Festival YouTube channel.

 

4. Finalist/Runner-up Notification:

 

The six (6) Eligible Entries that will take part in the Film Festival will be notified via University of Kentucky e-mail concerning their Entries by April 12th. All other Entries who do not qualify for the Film Festival will also be notified by the same date. All Finalists and Runner-ups (and project participants) will be invited to attend the Film Festival. Confirmation of intended attendance will be requested. Award winners will be announced during the course of the Film Festival. 

 

Entry Terms:

As part of the registration process for participation in the Film Festival, Entrants will be required to confirm that they have read, accept, and agree to be bound by these Regulations and the terms hereunder, including but not limited to the releases of liability, and the decisions of the Department, and the Judging Committee which are final and binding in all respects. By entering, each Entrant represents and warrants that he or she has obtained all of the rights, licenses, and permissions in writing from any person(s) who may have helped create or who may appear in the Entry; that his or her Entry conforms to these Regulations, and that the Entry:

 

(a) is the original work of the Entrant; (b) has permission to adapt a work if the literary piece is not in the public domain. Proof of permission is required and must be submitted to the Film Festival Committee. (c) has not previously been submitted in any competition and has not won an award or prize of any kind; (d) does not contain any use of the names, likenesses, photographs, or other identifying elements, in whole or in part, of any person, living, or dead without permission (proof of which must be provided to the Department upon request in a form satisfactory to the Department); (e) does not include trademarks, logos, or copyrighted material not owned by Entrant or material that is used without permission (including but not limited to company names, music, photographs, motion picture or television program clips or audio tracks, works of art, or images published on or in websites, television, movies, or other media) or that otherwise infringes or violates the rights of any third party (including but not limited to, copyrights, trademarks, patents, trade secrets, logos, contract and licensing rights, rights of publicity or privacy, moral rights (i.e., “droit morale”), or any other intellectual property rights); (f) except as set forth above, content of Entry is not subject to any third party agreement(s), and the Department will not be required to pay or incur any sums to any person or entity as a result of its use or exploitation of the idea or video or rights therein as contemplated in these Regulations; (g) does not defame, misrepresent, or contain disparaging remarks or any other content which could adversely affect the name, reputation or goodwill of the Department or any other individuals and/or entities, the determination of which shall remain in the sole discretion of the Department; (h) does not contain pornographic or sexual content, hateful content of any kind (including without limitation racism, sexism, etc.), content which promotes violence or harm to another living creature, or any other offensive, obscene or inappropriate content, the determination of which shall remain in the sole discretion of the Department; (i) does not include threats of any kind or that intimidate, harass, or bully anyone, or invade the privacy of any person, the determination of which shall remain in the sole discretion of the Department; (j) does not violate any applicable local, state, provincial, national or international law or include any content that would encourage or provide instructions for a criminal offense; (k) does not violate any University of Kentucky regulations concerning but not limited to drugs, alcohol, guns, code of conduct, etc. all of which is up to the student to review and comply with. (l)complies with any required permissions or similar regulations required by local authorities or property owners and that all required permissions have been obtained (including, but not limited to, permits for filming location) and are documented sufficiently such that Entrant can show proof of such permissions upon request from the Department. If, in the sole discretion of the Department, an Entrant has breached a representation or warranty, the Entry will be subject to disqualification.

6. Awards: TBD

 

All Awards will be rewarded at the Film Festival and are dependent on Sponsors/Donations. There is a limit of one (1) prize per project. Where prize constitutes more than one item divided the prize is up to the sole discretion of the Entrants. The Film Festival Committee is not responsible for equal distribution of Entry prizes between team members. Either the Group Representative or the entire team of an Entry must be in attendance in order to receive any and all prizes. Students are responsible for informing the Film Festival Committee of any conflict of scheduling in advance in order to still receive prizes for Finalists Entries.

 

7. Ownership of Entry and/or Video Rights:

 

Each Entrant will retain ownership of his/her Entry. However, by entering the Film Festival, and to the extent allowed by law, Entrants grant the Department, promotional partners, developers, and third party marketing entities (collectively, "Licensed Parties") a non-exclusive, perpetual, sublicensable, royalty-free license to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, dub, adapt, publish, broadcast, perform, exploit, and use the Entries themselves and the content of, and elements embodied in the Entries, including any names, locations, performances and likenesses, in any and all media, whether now existing or hereafter devised, including but not limited to digital and electronic media, computer, audio, and audiovisual media, in any language, throughout the world, in perpetuity, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to Entrant or any third party. To the extent permitted by law, each Entrant waives and releases the Licensed Parties, from and agrees to not exercise against the Licensed Parties, any and all claims that each Entrant may now or hereafter have in any jurisdiction based on “moral rights” or “droit moral” or unfair contest with respect to the Licensed Parties' exploitation of Entries without further notification or compensation to Entrants of any kind. Each Entrant agrees not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Licensed Parties or any other person in connection with this Film Festival, on the grounds that any use of any Entry or any derivative works thereof, infringe or violate any rights of any Entrant and/or any participant therein. For the avoidance of doubt, the Entrants agree to the publication of their Entries.

 

8. Rights of Publicity:

 

By entering the Film Festival, except where prohibited by law, each Entrant agrees that the Licensed Parties shall have the right and permission to use and announce the name, picture, voice, performance, biographical data, photograph, testimonial, or other likeness and/or prize information or personal exposition (and/or any edited portion thereof), and/or any information contained in his/her Entry for promotional, advertising, publicity, and/or other contest purposes in relation to the Film Festival in any media, now or hereafter known, including but not limited to digital and including but not limited to digital and electronic media, computer, audio, and audiovisual media, throughout the world, in perpetuity, without compensation or notice to, or further consent to the extent permitted by law.6

 

9. Limitations of Liability:

 

Except where prohibited by law and to the extent that the negative consequences described below are the foreseeable result of matters within the Department’s reasonable control and are the direct consequence of negligence or default by any of them, the Department of Hispanic Studies is not responsible for any incorrect or inaccurate entry of information, human error, technical malfunction, lost/delayed data transmission, omission, interruption, deletion, defect, line failure of any telephone, computer or other network, computer equipment, software or any combination thereof, inability to access the YouTube Site, for the inability to upload or download any Film Festival-related materials from the Department YouTube Channel, or for late, lost, damaged, misdirected, delayed, garbled, inaccurate, stolen, incorrect or incomplete Entries or votes.

 

EACH ENTRANT ACCEPTS THE CONDITIONS STATED IN THESE OFFICIAL CONTEST RULES, AGREES TO BE BOUND BY THE DECISIONS OF THE DEPARTMENT, WITHOUT PREJUDICE OF ANY CLAIM THAT COULD BE FILED BEFORE THE COURTS, WARRANTS THAT S/HE IS ELIGIBLE TO PARTICIPATE IN THIS FILM FESTIVAL, AND AGREES EXCEPT TO THE EXTENT THAT ANY PERSONAL INJURY OR DEATH IS CAUSED BY THE RELEASED PARTIES' NEGLIGENCE OR BREACH OF THESE OFFICIAL RULES AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW THATTHE RELEASED PARTIES SHALL NOT BE RESPONSIBLE FOR ANY CLAIMS, LOSSES, LIABILITY, AND DAMAGES OF ANY KIND (INCLUDING REASONABLE ATTORNEYS’ FEES AND EXPENSES), ASSERTED AGAINST ANY OF THEM, INCURRED, SUSTAINED, OR ARISING IN CONNECTION WITH THE USE, ACCEPTANCE, OR MISUSE OF ANY ENTRY MATERIAL, OR WHILE PREPARING FOR, PARTICIPATING IN, AND/OR TRAVELING TO OR FROM ANY FILM FESTIVAL-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO PERSON OR PROPERTY, OR FROM THE RESPECTIVE ENTRANT'S BREACH OF ANY AGREEMENT OR WARRANTY ASSOCIATED WITH THE CONTEST, INCLUDING THESE OFFICIAL REGULATIONS.ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE FILM FESTIVAL IS A VIOLATION OF THE LAW AND, SHOULD SUCH AN ATTEMPT BE MADE, THE DEPARTMENT RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR ANY SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. NOTWITHSTANDING THE REVIEW OF ANY ENTRY BY THE DEPARTMENT, EACH ENTRANT UNDERSTANDS AND AGREES TO BEAR SOLE LIABILITY FOR THE CONTENTS OF HIS/HER ENTRY AND AGREES TO REIMBURSE THE RELEASED PARTIES FOR ANY DAMAGES AND/OR COSTS INCURRED AS A RESULT OF A THIRD PARTY’S CLAIM OR DEMAND RELATING TO THE CONTENT OF HIS/HER ENTRY.

 

10. General Conditions:

 

The decisions of the Department and the Judging Committee are final and binding in all matters relating to this Film Festival, including interpretation and application of these Regulations without prejudice of any claim that could be filed before the court. The Department reserves the right not to enter into any correspondence, including email, with non-winning entrants. In the event of a dispute as to the identity of an Entrant based on an e-mail address, the Entry in question may be disqualified in the Department’s sole discretion. The Department reserves the right, in their sole discretion, to disqualify any individual found tampering with the entry process or entry materials or otherwise interfering with the proper administration of the Film Festival or violating these Regulations and void all associated Entries and/or votes. The Department may cancel, modify, or suspend the Film Festival (or portion thereof) due to a force majeure event or any other event beyond the Departments reasonable control. In the event of termination, the Department reserves the right, in its sole discretion, to determine the Finalists and Runner-ups from among all eligible Entries received up to time of such action using the judging procedure set forth herein. Each Entrant hereby acknowledges and agrees that the relationship between the Entrant and the Department is not a confidential, fiduciary, exclusive, or other special relationship, and that the Entrant’s decision to submit an Entry in connection with this Film Festival does not place the Department in a position that is any different from the position held by members of the general public with regard to elements of the Entry, other than as set forth in these Regulations.
